1. Общие положения

1.1. Настоящая публичная оферта (далее — «Оферта») регулирует отношения между ИП Исаев Роман Анатольевич (далее — «Продавец») и Пользователем (далее «Покупатель») в отношении продажи цифровых товаров и услуг, размещённых на сайте https://tolmust.com и других продуктах, распространяемых под брендом TOLMUST (далее — «Продукты»).

1.2. Продукты TOLMUST включают, но не ограничиваются:

• мобильной игрой SLEM;
• другими игровыми приложениями, доступными для скачивания через платформы Google Play, Apple App Store, Huawei AppGallery и другие.

1.3. Продавец предоставляет услуги и цифровые товары Пользователю на условиях настоящей Оферты, а также Политики конфиденциальности.

1.4. Продавец осуществляет все операции по продаже цифровых товаров через платёжные системы YooKassa, CloudPayments, а также через системы, интегрированные в платформы мобильных приложений (Google Play, App Store, AppGallery).

2. Права и обязанности сторон

2.1. Обязанности Продавца:

• Обеспечить Пользователю доступ к Продуктам TOLMUST после завершения оплаты.
• Обрабатывать информацию о платежах через сторонние платёжные системы (YooKassa, Cloud Payments).
• Предоставлять Пользователю информацию о его покупках (цифровые товары, предметы, подписки и т.д.).

2.2. Обязанности Покупателя:

• Ознакомиться с условиями настоящей Оферты перед покупкой Продуктов.
• Осуществить оплату цифровых товаров через предлагаемые платёжные системы.
• Соблюдать правила использования Продуктов, в том числе по авторизации через PlayFab.

3. Цифровые товары и оплата

3.1. Продавец предлагает Пользователю цифровые товары, включая, но не ограничиваясь:

• Внутриигровые предметы (скины, монеты, наборы и т.д.);
• Подписки на специальные услуги внутри игры;
• Иные товары, которые могут быть размещены в Продуктах TOLMUST.

3.2. Оплата за цифровые товары осуществляется через платёжные системы:

• YooKassa (для пользователей в России);
• CloudPayments (для международных пользователей);
• Платежные системы платформ Google Play, Apple App Store, AppGallery (встроенные платежи для мобильных приложений).

3.3. Все товары являются цифровыми, не имеют физической формы и не подлежат возврату после завершения оплаты, в соответствии с Постановлением Правительства РФ № 2463 от 31.12.2020.

3.4. Продавец не несёт ответственности за сбои в работе платёжных систем и платформ, включая ошибки в процессе авторизации и обработки транзакций.

4. Платёжные системы и условия использования

4.1. YooKassa: Продавец использует для приёма платежей систему YooKassa, c регистрационными данными: Shop ID 41000000000000 и Secret Key для тестовой и боевой среды. Продавец обязуется соблюдать все требования YooKassa и обеспечивать безопасность финансовых операций.

4.2. CloudPayments: Продавец использует CloudPayments для международных платежей. Система Cloud Payments также соответствует стандартам безопасности, включая PCI DSS.

4.3. Платформы Google Play, App Store, AppGallery: Все платежи внутри мобильных приложений обрабатываются через встроенные платёжные системы платформ (Google Play Billing, Apple In-App Purchase, Huawei IAP).

5. Интеллектуальная собственность

5.1. Все материалы, размещённые в Продуктах TOLMUST (в том числе текстовый контент, изображения, логотипы, торговые марки и программное обеспечение), являются объектами интеллектуальной собственности Продавца.

5.2. Покупатель получает ограниченную лицензию на использование Продуктов для личных, некоммерческих целей.

5.3. Покупателю запрещается изменять, копировать, распространять, публиковать или использовать Продукты TOLMUST для коммерческих целей без письменного разрешения Продавца.

6. Изменения в Оферте

6.1. Продавец оставляет за собой право изменять условия настоящей Оферты в любой момент. Изменения вступают в силу с момента их публикации на сайте https://tolmust.com/legal.

7. Применимое право

7.1. Все споры, возникающие в связи с настоящей Офертой, регулируются законодательством Российской Федерации.

7.2. В случае возникновения спора стороны обязуются сначала разрешить его путём переговоров. В случае недостижения соглашения, спор подлежит рассмотрению в суде по месту нахождения Продавца.

This Public Offer Agreement ("Agreement") regulates the relationship between the User ("User") and the developers of digital products under the TOLMUST brand, including but not limited to the website https://tolmust.com, the mobile game "SLEM," and other games and services (collectively referred to as the "TOLMUST Products").

TOLMUST products are developed and provided under the TOLMUST brand. All legal and financial activities are conducted by individual entrepreneurs, including, but not limited to: Individual Entrepreneur Isaev Roman Anatolyevich, INN 280117135158, OGRNIP 322280100021122.

This Agreement applies in conjunction with the Privacy Policy and constitutes a single legal framework for using TOLMUST Products.

1. General Provisions

1.1. TOLMUST Products are provided to the User for educational, entertainment, and commercial purposes under the terms of this Agreement.

1.2. The User is required to review the terms of this Agreement before using TOLMUST Products. The use of the Products constitutes acceptance of this Agreement.

1.3. TOLMUST Products are available in any country where their use does not conflict with local laws. The User confirms that they are legally allowed to use such products in their jurisdiction.

1.4. TOLMUST Products may be available for download through third-party digital stores, including Google Play, Apple App Store, Huawei AppGallery, and other platforms. The User agrees to comply with the terms of use, privacy policies, and payment systems of such platforms, in addition to this Agreement.

1.5. The Administration reserves the right to make changes to the text of this Agreement. The updated version will be published on the website https://tolmust.com/legal and will take effect from the moment of publication.

2. Authorization and Account

2.1. All website and game features of TOLMUST are available only after authorization through the third-party platform PlayFab (Microsoft).

2.2. The User agrees to comply with the rules and terms established by PlayFab. The Administration of TOLMUST is not responsible for login issues, loss of access, or authorization errors on the side of PlayFab.

2.3. The User is responsible for not sharing their login credentials with third parties and assumes personal responsibility for any actions taken under their account.

2.4. Accounts and in-game resources are part of the licensed platform and are not transferable, resalable, or otherwise alienated without the consent of the Administration.

3. Digital Products and Payment

3.1. TOLMUST Products may contain digital goods available for purchase via third-party payment gateways (YooKassa, CloudPayments, RuStore, etc.), as well as in-app payment systems of the platforms where the games are distributed (including Google Play Billing, Apple In-App Purchase, Huawei IAP).

3.2. All products are digital, intangible, and non-refundable once payment is completed, in accordance with Russian Government Decree No. 2463 dated 31.12.2020 and applicable international laws.

3.3. The completion of payment is considered the User's consent to receive the digital content within the functionality of the game.

3.4. Upon confirmation of payment by the payment system, the corresponding item, subscription, or resource is automatically provided to the User via the server or PlayFab system.

3.5. We are not responsible for delays related to technical limitations of PlayFab platforms, payment operators, or app stores.

4. Limitation of Liability

4.1. TOLMUST Products are provided "as is." We do not guarantee continuous operability, the absence of errors, or complete satisfaction of User expectations.

4.2. We are not responsible for failures, errors, or loss of access related to third-party platforms (PlayFab, payment services, mobile stores, etc.).

4.3. We are not responsible for actions of third parties, including cases of User account compromise, device hacking, or use of cheats.

5. Intellectual Property

5.1. All objects placed in TOLMUST Products (texts, images, audio, design, code) are objects of intellectual property and are protected by Russian and international law.

5.2. The User is prohibited from copying, distributing, modifying, or using any materials for commercial purposes without the written consent of the rights holder.

6. Age Restrictions

6.1. TOLMUST Products are not intended for users under the age of 13. If the User is under the age of consent, registration and access to functionalities must be authorized by the parents or legal guardians through the PlayFab authorization system.

7.2. We review requests within a reasonable time and may ask for confirmation of the identity associated with the PlayFab account.
